Privacy Policy

MGT respects the privacy of individuals and is fully committed to protecting sensitive and personal information in accordance with its obligations under applicable data protection law contained in the Digital Code of the Democratic Republic of Congo as published under Ordinance-Law-23-010-of-March-13-Bearing-Digital-Code.

General Privacy Policy Statements:

MGT adheres to the general principles of transparency, legitimate purpose and proportionality in the collection, processing, security, retention and disposal of personal information.

Employees, clients, customers, or third parties whose personal information is collected will be considered data subjects for the purposes of these policies.

The data subject shall be informed the reason or purpose of collecting and processing of personal data.

The data subject shall have the right to correct the information especially in cases of erroneous or outdated data, and to object to collection of personal information within the bounds allowed by privacy laws.

The data subject has the right to file a complaint in case of breach or unauthorized access of his personal information

MGT shall secure the personal information of employees and third parties from whom personal information is collected and shall take adequate measures to secure physical and digital copies of the information.

MGT will ensure that personal information is only collected and processed by authorized personnel for the legitimate purposes of the Organization.

Any information that is declared obsolete based on the internal privacy and retention procedures of the Organization shall be disposed of in a secure and legal manner.

Data subjects may request or request information from: legal@idrcsa.com, regarding any matter relating to the processing of their personal data in MGT's custody, including the privacy and data security policies implemented to ensure the protection of their personal data.

MGT recognizes the importance of a data subject's rights under applicable data protection law as follows:

  1. Right to be informed whether personal data concerning him/her will be, is in progress or has been processed
  2. Right to object to the processing of his/her personal information given and the possibility to refuse consent to the processing in case of changes or any modification of the information provided.
  3. Right of access, upon request, to the content of his/her personal data that has been processed, the sources from which the personal data was obtained, the names and addresses of the recipients of the personal data, the manner in which such data has been processed, the reasons for disclosing the personal data to the recipients, if any.
  4. Right to rectification in order to contest inaccuracy or error in personal data and to have it corrected immediately
  5. Right to erasure or blocking of personal data from the filing system
  6. Right to damages suffered as a result of such inaccurate, incomplete, obsolete, false, illegally obtained or unauthorised use of personal data
  7. Transferability of rights to the heirs and legitimate assigns of the data subject
  8. Right to data portability or the ability to move data from one platform or service to another

Collection of Personal Information

In collecting your personal information, MGT ensures that the data subject is aware of the nature, purpose and extent of the processing of his or her personal information.  The processing of the information is adequate, relevant, appropriate, necessary and not excessive in relation to a stated and specified purpose.

Personal information means any information, whether recorded in a physical form or not, from which an individual's identity is apparent or can reasonably and directly be ascertained by the entity holding the information, or when combined with other information, would directly and reliably identify an individual.

In the performance of our services, or as part of our transactions and dealings, we process and collect the following personal information which may include, but not limited to:

Name, marital status, Tax Identification Number, age, address, education, profession, business experience, business affiliation, family affiliation and any information from which identity of an individual is apparent or can be reasonably and directly ascertained, whether recorded in material form or not, such as CCTV footages and other visual recordings as part of our transactions with you.

Employment history, résumé and pictures sent with it, compensation and benefits, educational background, organizational affiliation, gender, date of birth, religion, ethnicity, civil status citizenship, physical medical history, past criminal and/or administrative records, government issued identifying information, payroll information of job applicants and current employees.

Company information, performance, history, and financial and capital, during vendor accreditation to engage in business transactions with us.

Information you provide us when you visit or use our company website and other mobile and online applications and any information you submit to our sales or customer relations agents for update of your records or information.

Use of Personal Information

The Processing of Personal Information is for purposes of:

  1. Identification in company records and corporate housekeeping;
  2. Corporate transactions and business operations;
  3. Compliance with the requirements, including reportorial obligations to relevant local government units, and other appropriate government agencies or offices;
  4. Maintenance of security within and around the premises
  5. Compliance with legal processes or lawful orders of judicial and quasi-judicial bodies, or any other government agencies and instrumentalities; and
  6. Any other legitimate business activities of MGT.

Sharing of Personal Information

MGT may share or disclose the personal information of data subjects to:

  1. Relevant local government units, and other appropriate government agencies or offices and other competent authorities that, by law, rule or regulation, require us to disclose personal information;
  2. Any judicial and quasi-judicial body or government agency pursuant to a lawful order;
  3. Any agent, contractor, consultant, advisor, auditor, underwriter or any service provider engaged by MGT to carry out legitimate business activities or services that ensures confidentiality and adheres to the provisions of applicable data protection law;
  4. Our employees or other staff members processing your transactions and requests.

Retention and Security of Personal Information

The personal information collected will be retained for as long as necessary to:

  1. To achieve the stated, specified, and legitimate purposes set out above, or where processing relevant to the purpose has been completed or terminated;
  2. Exercise or defend legal rights;
  3. Comply with laws, regulations, or legal orders of a court.

Subsequently, your personal data will be disposed of or deleted in a secure manner that would prevent further processing, unauthorized access or disclosure to any other party or the public.

MGT ensures the integrity and confidentiality of your personal information by providing appropriate and adequate organizational, physical and technical security measures, policies and procedures to reduce the risk of accidental destruction or loss, or unauthorized disclosure of or access to such information.  Physical access to servers and network equipment is heavily restricted to authorized personnel only. Various devices and security devices are used to protect the MGT network and its systems.

Policy Updates

The Data Privacy Policy will be updated periodically to comply with applicable laws, rules and regulations and to further improve security procedures in the processing of personal information.
